1. Website Terms and Conditions

1.1 Introduction

These Terms and Conditions govern access to and use of the website, services, quotations, bookings, inspections, and repair work provided by Pure PDR ("the Company", "we", "us", "our").

By accessing this website, submitting an enquiry, requesting a quotation, booking a service, or instructing the Company to perform work, the customer accepts these Terms and Conditions.

1.2 Company Details

Pure PDR is the trading name of Memory of Africa (Pty) Ltd, conducting business in South Africa.

1.3 Scope of Services

The Company provides automotive cosmetic repair and related services including, without limitation:

  • paintless dent removal (PDR)
  • hail damage rectification
  • dent assessments
  • mobile repair services
  • workshop-based repair services
  • cosmetic panel correction where suitable

All services remain subject to technical feasibility, scheduling availability, geographic location, vehicle condition, and operational capacity.

1.4 Quotations and Estimates

  1. All telephonic, online, email, WhatsApp, or photograph-based quotations are preliminary estimates only.
  2. Final pricing is subject to physical inspection of the vehicle.
  3. The Company reserves the right to revise quotations where hidden damage, restricted access, prior repairs, corrosion, stretched metal, repainting, or additional defects are identified.
  4. No work outside the approved scope will be performed without customer approval where reasonably practicable.

1.5 Deposits and Payment

  1. The Company may require a booking deposit, including a 50% deposit for selected repairs.
  2. Deposits secure labour allocation, booking capacity, and scheduling resources.
  3. Unless otherwise agreed in writing, all outstanding balances are payable immediately upon completion of work and prior to vehicle release.
  4. The Company reserves all rights available in law in respect of unpaid accounts.

1.6 Repair Limitations

  1. Paintless dent removal is a specialised process and outcomes vary according to damage severity, panel design, access, metal memory, paint condition, prior repairs, and other factors.
  2. The Company does not warrant that every dent can be restored to invisible or factory-original condition.
  3. Reasonable skill and care will be exercised in pursuit of the best commercially achievable result.

1.7 Prior Repairs / Paint Risk

Where a panel has previously been repainted, filled, repaired, corroded, weakened, or otherwise compromised, repair processes may reveal or aggravate existing defects including:

  • paint cracking
  • lacquer separation
  • filler failure
  • visible distortion
  • finish irregularities

The customer acknowledges such pre-existing risk.

1.8 Vehicle Custody and Storage

  1. Where a vehicle is left in the Company's custody, reasonable care shall be exercised.
  2. Customers must remove all valuables and personal property prior to handover.
  3. The Company accepts no responsibility for undeclared valuables left in a vehicle.
  4. Vehicles not collected within a reasonable time after notification may attract storage charges.

1.9 Mobile Services

For on-site or mobile services:

  • safe and adequate workspace must be available
  • suitable lighting and weather conditions must exist
  • legal access to the vehicle must be provided

The Company may postpone or decline work where conditions are unsafe or unsuitable.

1.10 Warranty

Workmanship warranties, where expressly offered, are subject to separate written warranty terms.

1.11 Marketing Media

Unless expressly declined in writing prior to commencement of work, the customer grants consent for non-identifiable before-and-after imagery of the vehicle to be used for marketing purposes.

1.12 Limitation of Liability

To the fullest extent permitted by South African law:

  1. The Company shall not be liable for indirect, consequential, incidental, or special damages.
  2. Any direct liability proven against the Company shall be limited to the amount paid by the customer for the relevant service giving rise to the claim.

1.13 Governing Law

These Terms shall be governed by the laws of the Republic of South Africa. Any dispute shall be subject to the jurisdiction of competent South African courts.

2. Privacy Policy (POPIA)

2.1 Responsible Party

Memory of Africa (Pty) Ltd t/a Pure PDR is the responsible party for purposes of applicable data protection legislation.

2.2 Information Processed

The Company may process:

  • names
  • telephone numbers
  • email addresses
  • physical addresses
  • vehicle details
  • photographs of damage
  • payment records
  • communication records
  • website analytics and technical usage data

2.3 Purpose of Processing

Information may be processed for:

  • quotations
  • bookings
  • repairs
  • customer communication
  • invoicing and collections
  • warranty administration
  • fraud prevention
  • insurance coordination
  • service improvement
  • lawful marketing communications

2.4 Disclosure

Information may be disclosed where reasonably necessary to:

  • employees and authorised contractors
  • payment processors
  • insurers / assessors
  • IT or hosting providers
  • professional advisers
  • authorities where legally required

2.5 Retention

Records may be retained for operational, contractual, warranty, tax, accounting, legal, fraud prevention, insurance, and dispute resolution purposes for such periods as reasonably required.

2.6 Security

The Company implements reasonable administrative, technical, and organisational safeguards to protect personal information.

2.7 Requests and Complaints

Requests relating to personal information may be submitted in writing to the Company and will be handled subject to applicable law and lawful record-retention obligations.
